By contributing to the clarification of the legal framework governing medical liability, the Italian Supreme Court's judgment No. 14258 of 2020 adds a further piece to the complex mosaic of case law and legislation in this field. The Court held that the relatives of a patient who died by suicide cannot bring an action against the healthcare institution to recover damages suffered iure proprio on the basis of contractual liability. In the Court's view, the doctrine of the contract with protective effects in favour of third parties cannot be invoked in such circumstances, as its application is confined to cases in which the third party's interest is closely connected with the interest already contemplated within the contractual arrangement, as occurs, for example, in the relationship between a woman in childbirth and the healthcare institution or medical professionals providing her care.
La pronuncia della Cassazione n. 14258 del 2020, contribuendo all’opera di messa a fuoco della disciplina della responsabilità medica, intende aggiungere un tassello al caleidoscopico mosaico giurisprudenziale e normativo: i familiari del paziente che si è tolto la vita non possono agire nei confronti della struttura sanitaria per il risarcimento dei danni patiti iure proprio facendo valere una responsabilità di tipo contrattuale. Non sembra infatti possibile invocare in questo caso la figura del contratto con effetti protettivi nei confronti del terzo, la cui applicabilità è circoscritta alle fattispecie ove l’interesse di cui sia portatore il terzo risulti strettamente connesso a quello regolato già sul piano della programmazione negoziale, come avviene nell’ambito delle relazioni intercorse specificamente tra la puerpera e la struttura o i sanitari.
