The subject of the sanctioning power of independent administrative authorities has assumed increasing prominence in recent years, especially because of the interests it affects. The sanctions of these Authorities, also given their tendency to be more serious, are more frequently challenged in the courts: this has contributed to the fact that the sector under consideration has in many cases been a privileged seat for the formation of jurisprudential orientations often of significant creative importance. The question about the direct applicability of Law 689/1981 and more specifically Article 14 of Law 689/1981 to antitrust proceedings has become increasingly popular in the recent period as an independent ground of appeal, this also to denounce the often unjustified inertia of the Antitrust Authority in the investigation and contestation of alleged antitrust violations, thus exposing businesses and companies to serious dangers and violations of their rights of defense.
