The sentence examined - pronounced before the appointment of the independent expert called to facilitate the negotiated settlement for the solution of the business crisis - is interesting because it constitutes one of the first applications of art. 10, paragraph 1, lett. a), D.L. n. 118/2021, and because it has the effect of significantly affecting the out-of-court reorganization path outlined by the Legislator. In fact, it highlights the uncertainties regarding the role reserved to the judicial authority within the new procedure.
