The annotated judgment addresses the issue of the effectiveness of the decree of enforceability of the passive state, in relation to its indisputability in a different context with respect to the bankruptcy procedure. The Court rejects the judicial action brought, as aimed at countering the finality of the decree that makes the passive state executive. The essay traces the jurisprudential and doctrinal debate that, before the italian reform intervened with the D.Lgs. 9 January 2006, n. 5, had already led to affirming the (only) internal effects of the decree of enforceability of the passive state. The Author proposes a brief systematic reflection on the issue, also in the light of the new Codice della crisi d’impresa e dell’insolvenza.

La sentenza annotata affronta il tema dell’efficacia del decreto di esecutività dello stato passivo, in relazione alla sua inoppugnabilità in una sede diversa rispetto al procedimento fallimentare. Il Tribunale respinge l’azione promossa, poiché volta a contrastare la definitività del decreto che rende esecutivo lo stato passivo. Il saggio ripercorre il dibattito giurisprudenziale e dottrinale che, prima della riforma intervenuta con il D.Lgs. 9 gennaio 2006, n. 5, aveva già condotto ad affermare l’efficacia (solo) endofallimentare del decreto di esecutività dello stato passivo. L’Autore propone una breve riflessione sistematica sul tema, anche alla luce del nuovo Codice della crisi d’impresa e dell’insolvenza.
