The essay reconstructs the legal framework of the non-material legal rela- tionship, by identifying the similarities with the patrimonial legal relation- ship. The structure of the non-material legal relationship, especially the fam- ily relationship, enables it to be included within a "contractual framework", with important consequences on the legal nature of the intrafamily liability.
Il saggio ricostruisce la categoria del rapporto giuridico non patrimo- niale, individuando le affinità con quello di carattere obbligatorio. La struttura del rapporto non patrimoniale, specialmente di quelli di tipo familiare, consente di inserirlo entro un “quadro contrattuale” con importanti ricadute anche in termini di qualificazione della responsa- bilità endofamiliare.
