The article offers a systematic reinterpretation of the best interest of the child, arguing that it should not be regarded as a fundamental right or as an interest to be balanced against competing rights, but rather as the supreme principle governing child law and as a direct expression of the constitutional principle of the full development of the human person. Drawing upon international, European and domestic legal sources, together with leading scholarly writings and judicial decisions, the paper demonstrates that the best interest of the child functions as an interpretative criterion and a standard of reasonableness guiding the balancing of fundamental rights towards the effective protection of the child’s personality. Accordingly, the principle cannot itself be reduced to the object of balancing, but performs a constitutive normative function grounded in dignity and solidarity. The study therefore provides a coherent dogmatic framework capable of overcoming the enduring uncertainties surrounding the legal nature and operation of the principle.
L’articolo propone una rilettura sistematica del principio del best interest of the child, sostenendo che esso non costituisce un diritto fondamentale né un interesse da bilanciare con altri diritti, ma un principio apicale dell’ordinamento minorile, espressione diretta del principio personalista di cui agli artt. 2 e 3 cost. Attraverso un’analisi delle fonti multilivello, della giurisprudenza nazionale e sovranazionale e della piú autorevole elaborazione dottrinale, si dimostra che il migliore interesse del minore opera quale criterio interpretativo e parametro di ragionevolezza nel bilanciamento tra diritti fondamentali, orientandone l’esito verso la piena realizzazione dello sviluppo della persona minorenne. Ne consegue la sua irriducibilità e il riconoscimento di una funzione normativa costitutiva, capace di conformare la legalità alla luce della dignità e della solidarietà. L’indagine offre cosí una ricostruzione dogmatica unitaria del principio, idonea a superare le persistenti incertezze interpretative.
