The paper analyses employer liability in the use of artificial intelligence systems, in light of the regulatory framework introduced by the AI Act. Particular attention is paid to the relationship between providers and deployers and to the difficulties in attributing liability arising from the opacity of AI systems. The analysis compares the solutions offered by civil and labour law, exploring possible liability models capable of balancing technological innovation, worker protection and legal certainty.
