Abstract

After several years, a constitutional litigation initiated by an individual member of Parliament has returned to the Court. The dispute, directed against a law decree that incorporated a legislative text already at an advanced stage of parliamentary examination — thereby rendering it immediately effective — was declared nadmissible. Notwithstanding the sound nature of the ruling, primarily due to procedural deficiencies in the introductory motion, the issue of violations of the legislative process has forcefully resurfaced, particularly in the absence of a decisive stance by the Court.
