The author highlights the conflict between the ban on surrogacy – deemed contrary to human dignity and international public order – and the principle of the best interests of the child, which requires the protection of the child regardless of the unlawfulness of the parents’ conduct. The structural limitations of adoption in special cases are highlighted, as it is considered unsuitable to ensure effective, timely and stable protection of the child’s status. Furthermore, the article examines the proposal provided by the Court of Cassation to extend, in a constitutionally oriented manner, the provisions of Articles 251 and 278 of the Civil Code, in-tended for children born from ‘incestuous’ relationships, to cases of parentage arising from surrogacy. Ac-cording to the author, a solution based on the principles of the unique status of a child and on the centrality of the child’s dignity would make it possible to overcome the irrationalities of the legal system and to ensure full protection of the fundamental rights of the child.

L’autore evidenzia il conflitto tra il divieto della surrogazione di maternità, ritenuta contraria alla dignità uma-na e all’ordine pubblico internazionale, e il principio del Best Interest of the Child, che impone di tutelare il minore indipendentemente dall’illiceità della condotta dei genitori. Vengono messi in luce i limiti strutturali dell’adozione in casi particolari, considerata inidonea a garantire una tutela effettiva, tempestiva e stabile dello status del nato. Il commento approfondisce quindi la proposta avanzata da Cass., I sez., ord. 12.3.2026, n. 5656 di estendere, in via costituzionalmente orientata, la disciplina degli artt. 251 e 278 cod. civ., prevista per i figli nati da rapporti “incestuosi”, anche ai casi di filiazione derivante da maternità surroga-ta. Secondo l’autore, una soluzione fondata sull’unicità dello status di figlio e sulla centralità della dignità del minore consentirebbe di superare le irragionevolezze dell’attuale sistema e di assicurare piena tutela ai diritti fondamentali del nato.
