BANCHE E ORDINAMENTO BANCARIO ALLA PROVA DELLA CAPITAL MARKETS UNION: ALCUNE SUGGESTIONI

The article aims to put forward some thoughts drawing on the scant references in the recent legislative “packages” concerning the banking sector and relating to the European Capital Markets Union (despite its relevance for the banking industry and the close correlation between Capital Markets Union and Banking Union). On the basis of some concrete examples, the contribution points out the risk of disharmonious development of the financial system affecting the relationship between its sectoral components.

La relazione propone alcune riflessioni traendo spunto dalla parsimonia di riferimenti al comparto bancario che si riscontra nei più recenti “pacchetti” di iniziative legislative volte a realizzare l’Unione europea dei mercati dei capitali, nonostante la centralità anche per le banche delle materie che vi vengono trattate e malgrado la stretta correlazione tra Capital Markets Union e Unione Bancaria. Sulla scorta di talune esemplificazioni concrete, si stigmatizza il rischio di uno sviluppo disarmonico dell’ordinamento finanziario nei rapporti tra le sue singole componenti.
