This contribution aims to examine the jurisprudential and normative framework surrounding the Tribunale di Roma judgment No. 11841/2025 and to reflect on the potential outcome of the case filed by Germany against Italy in 2022, which is still pending before the International Court of Justice. Specifically, it will explore whether the continued circulation of the “humanitarian exception” to State immunity could result in a new ruling against Italy, also considering the possibility that the establishment of the so-called compensation fund (“Fondo ristori”) reflects a political compromise with Germany.

Abstract
