The essay focuses on the issue regarding the applicability of consumer law to condominium contracts, particularly those concluded by the administrator with a “professional” in the execution of the resolutions of the assembly. The rigid interpretation of the notion of “consumer”, as a natural person acting for purposes unrelated to the professional activity possibly carried out, not only has to face the unsolved problem of the legal nature of the condominium; moreover, the possibile extension of the consumer protection to condominium contracts should also take into account the correct definition of the relations between owners who are not natural persons, the administrator as a professional worker and the assembly where the management of common goods is absorbed in the group organisation.
