The broad concept recently assumed by the Court of Justice about “data concerning health”, which includes also personal data that are not so closely health-related, is challenging, taking into account the consequences that may follow for e-commerce. Otherwise, it is essential to reconsider the notion of data concerning health and its processing, especially after the other conclusion reached by the European Court on the infringement of EU Reg. No. 679/2016 and the possibility for a company to take action in civil court if so provided under the national unfair competition rules.

Abstract

The broad concept recently assumed by the Court of Justice about “data concerning health”, which includes also personal data that are not so closely health-related, is challenging, taking into account the consequences that may follow for e-commerce.
