Human trafficking is one of the greatest challenges the international community is facing and this threat to human rights and human dignity is likely to become more and more present due to the conflicts that have been disrupting international peace and security in the last 15 years, and today more than ever. This paper, after exploring the link between conflict-related human trafficking and gender inequalities rooted in numerous patriarchal realities, explores the criminal relevance of the phenomenon, with specific regard to the role of the International Criminal Court. The contribution is aimed at opening a reflection on the possibility of amending Rome Statute to include trafficking in human beings among its core crimes. This argument is driven by the idea that, while it is necessary to place a human rights-based approach at the centre of any discourse related to trafficking, the criminal justice instrument may be the appropriate venue to bring justice to victims.
