The aim of this essay is to verify, also in the light of some experiences of collective bargaining, the practicability of the prohibition of non-discrimination and, ex adverso, of the principle of equal treatment, with regard to types other than the ‘historical’ one of the full-time and open-ended subordinate employment con- tract: that social-typical figure that not only Umberto Romagnoli identified as the recipient of the logic of protection of labour law. In addition to the types commonly defined as non-standard, however, the interest also wants to be that of the legal approach in anti-discriminatory terms with re- spect to non-subordinate work, including in this meaning not only the cases falling under Article 2222 of the Civil Code, but also all those relations, yesterday and even today subsumed under the well-known expression of so-called parasubordination.
