The article comments and contextualises Case C-621/21, WS, Judgment of the Court of Justice (Grand Chamber) of 16 January 2024, EU:C:2024:47. The comment will proceed as follows: we will first describe the underlying facts of the case, as well as the evolution of the legal interpretation thereof, starting with the Opinion of the Advocate General (AG) and then moving onto the final judgment (sections 2–4). We will then analyse how the adopted solution may impact the interpretation of EU law more broadly (section 5).
