The primary role played by Facebook places the social network in a pre-eminent position in implementing some of the key principles of the constitutional order (such as that of the pluralism of political parties ex 49 Cost.). This role appears to be crucial to the point that the subject excluded from Facebook is in fact limited or excluded from freely participating in the political debate. This special position means that Facebook, in its negotiations with users, must strictly adhere to the respect of the constitutional and regulatory principles that constitute both a condition and a limit in the relationship with the subjects who request access to the service. On this basis, the exclusion of the appellants from Facebook, being in conflict with the principle of political pluralism, may cause serious harm that is not susceptible to compensation for equivalent to be assessed through a full knowledge procedure.
