Hate speech e comportamenti d'odio in rete il caso Forza Nuova vs. Facebook

The subject of the right to free expression of thought and its limits, in particular in relation to messages inciting hatred and discrimination, is regulated by numerous national and supranational sources of law. From the complex framework of legal sources it clearly emerges that among the limits to the freedom of expression of thought, respect for human dignity and the prohibition of any discrimination assume particular importance, to guarantee the inviolable rights of every person. Legal obligations impose not only on States but also on private entities that carry out activities of undoubted social importance (such as many of the services offered by social networks), to prevent those forms of expression that spread, incite, promote or justify hatred based on intolerance. In this case, Facebook could terminate the contract in consideration of both the complex regulatory system referred to in relation to hate speech and hate speech and for the violation of the contractual clauses expressly provided for, otherwise risking incurring forms of legal liability.
