The article analyses the case of witnessing violence in light of the Council of Europe Istanbul Convention adopted in 2011. It demonstrates that the Convention has contributed to legally recognising ‘witnessing violence’ and provides measures aimed at protecting children victims of violence within their family. The article also reflects on the relevant jurisprudence of the European Court of human rights and on a recent case brought before Italian courts.
