The article critically examines a decision of the Supreme Court of Cassation concerning the nature of the obligations in the condominium, also considering the new Article 63, par. 2, of the provisions implementing the Civil Code. The solution requires a broad analysis of the relationships existing between the condominium itself, individual owners, and third-party creditors. As far as what happens within the forms of management of common interests, the nature of the relationships existing between those subjects inevitably bends the discipline of the obligations.
