L'identità personale del minore di età nel cyberspazio tra autodeterminazione e parental control system

The essay highlights the peculiarities of the protection of the personal identity of the child within the cyberspace. After having considered the formative moment of personal identity, which might consume any identity issue of the minor, the analysis focuses on the educational role of parents and the assurance of its exclusivity, especially in the digital social life of the minor. The parental control, as regulated by the recent legislative acts, contains several drawbacks , for instance where it does not differentiate children on the basis of their age, thus neglecting to strengthen the role of the self-determination that the legal system recognizes to minors with the capacity for discernment.

Il saggio muove dall’analisi delle peculiarità della tutela dell’identità personale del minore nel cyberspazio. Dopo aver focalizzato il momento formativo dell’identità personale, che nel minore di età può anche esaurire la questione identitaria, l’indagine si concentra sul ruolo educativo dei genitori e sulla necessità di garantirne l’esclusività, specialmente nella vita sociale digitale del minore. Lo strumento del parentale control, così come regolato dalla recente normativa, presenta elementi di criticità laddove non differenzia la minore età, trascurando così di valorizzare lo spazio di autodeterminazione che il sistema ordinamentale accorda al minore munito della capacità di discernimento.
