La materia elettorale come laboratorio per la parità di genere: lente di ingrandimento della concezione antisubordinazione

Starting from a gender-based perspective, we can analyze several national, European and international provisions dealing with gender discrimination. In particular, through a legal realism approach and a comparative method we can consider the electoral law (at different levels) and the positive actions adopted in this specific law field in order to increase true equality among sexes. Therefore, we can underline that these means are not sufficient to reach parity between men and women. For this reason, it is vital to assume an “antisubordination” approach, that states that gender discrimination is mainly founded on social and cultural prejudice. Thanks to the comparison with the French legal system and to the international provisions, we can find two innovative tools to deal with the above mentioned issue. First, it is important to change the present electoral law. Secondly, it is fundamental to create educational programs about equality among sexes.
