Telemedicina ed essenza fiduciaria del rapporto di cura

After having outlined the political and regulatory framework of telemedicine practices, the essay depicts the function of telemedicine in the doctor-patient relationship, by affirming the instrumental nature of the former over the latter. Therefore, the sole algorithmic decision-making process in healthcare is excluded; quite the opposite, the analysis should focus on patient risk exposure, which is undoubtedly exacerbated in telemedicine practices due to the usage of intelligent medical devices. Finally, the article addresses the different types and "centres" of liability.

Delineato il contesto politico e normativo delle pratiche di telemedicina, il saggio ricostruisce la funzione delle stesse nel rapporto di cura tra medico e paziente, giungendo ad affermare il loro carattere necessariamente strumentale. Esclusa quindi la possibilità di demandare funzioni decisionali agli algoritmi impiegati in ambito sanitario, l’indagine si concentra sull’esposizione al rischio del paziente, senz’altro aggravata dall’utilizzo nella telemedicina di dispositivi medici intelligenti, nonché sulle diverse forme e centri di responsabilità.
