Il dovere di rispettare i genitori nella coercibilità dell'ordinamento giuridico

The duty of the children to respect their parents, as it is set out by the last paragraph of Article 315-bis of the Italian Civil Code, is subject to a hermeneutical reinterpretation, which is closer to the current legal system of family relations, as well as more sensitive to the transformative and relational aspects of filiation. The coercibility of the duty of children to their parents is then found within the supporting measures that the law provides to family relations along the side of solidarity.

l dovere dei figli di rispettare i genitori, sancito dall’ultimo comma dell’art. 315-bis c.c., è sottoposto a una rilettura ermeneutica, aderente agli attuali assetti del sistema ordinamentale dei rapporti familiari e sensibile alle vicende evolutive e relazionali del singolo rapporto di filiazione. Si giunge così a definire l’ambito di coercibilità del dovere nel senso delle misure di sostegno che il diritto deve alla famiglia anche nel versante della solidarietà.
