The recent ruling of the European Court of Justice in the case Meta Platforms v. the German Federal Union of Consumers Organisations and Associations acts as a starting point for some reflections upon the potential of aggregate litigation in data protection law. Moreover, the essay evaluates the potential of the newly adopted Dir. (EU) 2020/1828 on representative actions for the protection of the collective interests of consumers, its relationship with article 80 GDPR, and introduces the concept of “group data protection”. To conclude, the paper articulates some considerations regarding group actions and data protection in the Italian legal system.
