The Author examines the common representations of the platform work and observes that the aspects inherent to the phase of relationships preceding the performance, and not concerning the alternative obligation/freedom to work, are underestimated. According to the Author, this encourages interpretations implying the relationship’s fragmentation into an indeterminate series of contracts, to the point of undermining the contractual origin of the qualifying operations. In the contribution, therefore, it is proposed to analyze the “concrete” causa of the relationships in order to identify other aspects of the relationships able to guarantee the unity of the contract by providing legal relevance to the legal durability of the relationship. This approach leads the Author to value, even for the qualification’s purpose, the situations of power/subjection characterizing work through platforms and to emphasize how they bring to the fore the interpretations of art. 2094 of the Italian Civil Code which downsizes the role of the performance to the advantage of profiles capable of photographing the overall contractual structure. The Author concludes by considering that such relationships cannot be conceived as a series of independent contracts, nor as “co.co.co.”, but also that the other hypotheses (like subordination or hetero-organization) must pass through an update of the traditional interpretation.

L’Autore esamina le rappresentazioni comuni del fenomeno del lavoro tramite piattaforme digitali ed osserva che gli aspetti inerenti alla fase pre-esecutiva dei rapporti, non riconducibili all’alternativa obbligo/libertà di lavorare, siano sottovalutati. Secondo l’Autore ciò incoraggia le interpretazioni che sottintendono la frammentazione del rapporto in una serie indeterminata di contratti, fino a mettere in crisi il presupposto contrattuale delle operazioni qualificatorie. Nel contributo, quindi, si propone di analizzare la causa concreta dei rapporti per ritrovare l’unitarietà negoziale del fenomeno facendo leva sul suo carattere durevole. Questo approccio induce l’autore a valorizzare, anche in sede di qualificazione tipologica, le situazioni di potere/soggezione che caratterizzano il lavoro tramite piattaforme e a sottolineare come esse richiamino alla ribalta le interpretazioni dell’art. 2094 c.c. che ridimensionano il ruolo della prestazione tipica a vantaggio di profili della fattispecie capaci di fotografare l’assetto negoziale complessivo. L’Autore conclude ritenendo che i rapporti in questione, almeno secondo i modelli oggi noti, non possono essere concepiti come una serie di contratti di lavoro indipendenti, né come co.co.co., ma che le altre ipotesi ricostruttive (subordinazione o eteroorganizzazione) devono passare per un aggiornamento dell’interpretazione delle fattispecie astratte di riferimento.
