Quale degno destino per gli embrioni soprannumerari?

The essay focus on the debate on the balancing of human rights in the prenatal period, by distinguishing the situation of in utero embryos and in vitro embryos. Hence, attention is placed on the fate of supernumerary embryos, considering the coordinates of the conflict that may arise between different fundamental interests, moving from the dignity of the human embryo. After having identified its rationale on the protection of the embryo’s life to be born, the author admits, under certain conditions, the adoption of supernumerary embryos, as well as identifying the ‘borderline cases’ of non-implantable embryos, in which a dignum fate of the embryo other than birth can be imagined.

Il contributo riprende il dibattito sull’estensione e il possibile bilanciamento dei diritti che fanno capo all’uomo nella fase prenatale, tenendo distinta la situazione dell’embrione in utero rispetto a quella dell’embrione in vitro. Ci si interroga, dunque, sul destino degli embrioni soprannumerari, valutando le coordinate del conflitto che può prospettarsi tra diversi interessi costituzionalmente protetti muovendo dalla dignità dell’embrione. Individuato l’ordine di senso nella tutela della vita dell’embrione per la nascita, si giunge ad ammettere, a determinate condizioni, l’adozione degli embrioni soprannumerari e a individuare i “casi limite” di non impiantabilità, rispetto ai quali può ipotizzarsi un degno destino dell’embrione diverso dalla nascita.
