Objectives: this article aims to understand which are, within the Italian legal system, the judicial tools available to trade unions that are willing to turn to litigation to protect workers subject to algorithmic management practises. Methodology: after having identified, on the basis of previous managerial and legal research, the risks connected to the always more massive use of algorithmic management devices, this article, through a legal-normative analysis, aims to identify the procedural devices that can be used by trade unions to avoid that the abovementioned risks will materialise. Results: the Italian legal system offers to trade unions, unlike in the past, many procedural tools to be used to reinforce industrial action through a more effective use of the litigation. From this point of view, the claims proposed in the field of algorithmic management may constitute an interesting testing ground to experiment these judicial devices, among which it needs to be recalled the class action, which has recently been transformed in a general procedural remedy. Limits and implications: this article offers to trade unions a series of theoretical and practical hints on the reasons that would justify a greater use of litigation as a tool to better protect workers subject to algorithmic management practises. The impact of the research is dependent on the interest that trade unions will show to litigation as a tool to reinforce industrial action. Originality: this article offers effective solutions to face new issues that, as at today, have not been widely analysed by labour law scholarship.
Obiettivi: questo articolo si propone di comprendere quali siano, nell’ordinamento italiano, gli strumenti a disposizione del sindacato che intenda utilizzare il processo come mezzo utile a tutelare i lavoratori soggetti a pratiche di algorithmic management. Metodologia: dopo aver individuato, sulla base della dottrina aziendalistica e giuridica pregressa, i rischi sottesi all’uso sempre più massiccio di strumenti di algorithmic management, l’articolo, mediante una analisi giuridico-normativa, si propone di individuare gli strumenti processuali utilizzabili dal sindacato per evitare che i suddetti rischi si concretizzino. Risultati: l’ordinamento processuale italiano offre oggi al sindacato, a differenza del passato, strumenti processuali utili a rilanciare la propria azione mediante un utilizzo più incisivo del processo. Da questo punto di vista, le controversie in materia di algorithmic management potrebbero costituire un interessante banco di prova per la sperimentazione di questi strumenti di tutela giurisdizionale, tra cui la c.d. “class action”, di recente trasformata in un rimedio processuale di carattere generale. Limiti e implicazioni: l’articolo fornisce al sindacato una serie di spunti teorico-pratici sulle ragioni che giustificherebbero un maggior ricorso allo strumento giudiziale come mezzo utile a tutelare i lavoratori soggetti a pratiche di algorithmic management. L’impatto della ricerca dipenderà dall’interesse che le OO.SS. mostreranno nei confronti della tutela giurisdizionale come strumento di rilancio della propria azione. Originalità: l’articolo propone soluzioni concrete per far fronte a problemi nuovi che, ad oggi, non sono ancora stati diffusamente affrontati dalla dottrina giuslavoristica.
