Il caso airbnb: un complesso bilanciamento rimediale tra tutela della comunità e autonomia negoziale durante la pandemia

The present paper is focused on the analysis of the contractual remedies adopted by the well- known sharing economy platform Airbnb, in order to counter the ongoing pandemic crisis due to the spread of Covid-19 virus. The investigation of emergency contractual measures and their suit- ability for mitigating the possible negative impact on trade relations become a great inspiration for the analysis of the contractual relations in the digital market and the different – or apparently conflicting – interests from which they are composed. The balance between collective interests and the freedom of contract– even if necessary – in such a pandemic situation seems widely complex.
