Cristianesimo, diritto civile, "famiglie": evoluzione di un radicamento culturale.

Concerning the openness of the legal system of the State to the new cultural models of the family, which is followed by the erosion of the family model based upon marriage, the relationship between law and the Judeo-Christian religious tradition seems to be definitely over. Otherwise, the essay shows how this relationship continues, even though in different terms than in the past. The point of continuity, which is rooted in the European culture, can be found in the role played by principles, which have different outcomes in the system of the State and the Church with respect to juridical effects.

Rispetto alle aperture dell’ordinamento giuridico statuale ai nuovi modelli culturali di famiglia, accompagnate dall’erosione del modello di famiglia matrimoniale, parrebbe essere definitivamente tramontato il rapporto tra diritto e tradizione religiosa giudaico-cristiana. Il saggio tende invece a dimostrare come questo rapporto continui a persistere, sia pure in termini diversi rispetto al passato. Il punto di contatto, radicato nella cultura dell’Europa, si ravvisa nei principi, i quali conoscono nell’ordinamento dello Stato e in quello della Chiesa differenti esiti in termini di giuridicità.
