In this paper, the link between domestic violence and divorce proceedings will be analysed in light of the New Law and other existing legislation. In particular, this will include an analysis of the strengths and weaknesses of the use of divorce in cases of family abuse, not only taking into account recent legislative developments and trends in legal doctrine and jurisprudence, but also the social dimensions influencing the debate on domestic violence in contemporary China. Furthermore, a section will be dedicated to the Personal Safety Protection System that, in the New Law, finally gained its autonomy from divorce proceedings.

Abstract
