Prove tecniche di regionalismo “differenziato”: considerazioni critiche intorno alle fonti attuative dell’art. 116, comma 3, Cost.

This paper aims to analyse one of the problematic profiles underlying the theme of “differentiated” regionalism, concerning whether or not implementing the regulation under art. 116, paragraph 3, of the Italian Constitution, with particular attention being paid to the debate relating the need or the mere opportunity of an interpositio legislatoris; to the relationship between the several state and regional sources called to contribute to the potential implementation; to the possible regulatory profiles referred to the implementing state source and to the ordinary or constitutional level of the latter.

Il saggio si prefigge l'obiettivo di esaminare uno dei profili problematici sottesi al tema del regionalismo “differenziato”, quello relativo alla necessità o meno di un’attuazione normativa dell’art. 116, comma 3, Cost., prestando particolare attenzione al dibattito attorno alla necessità o alla mera opportunità di un’interpositio legislatoris; ai rapporti tra le diverse fonti statali e regionali chiamate a concorrere all’eventuale attuazione; ai possibili profili di disciplina rimessi alla fonte statuale attuativa e al rango ordinario o costituzionale di quest’ultima.
