The paper aims to analyse the new features that characterize the concept of care relationship as a result of some recent changes in the ways of provision of health services. Especially, it intends to evaluate the possibility that care relationship could be established between patients and healthcare institutions instead of between patients and doctors working in these institutions. The paper leads therefore to some remarks concerning the attribution of liability to the different parties involved in the relationship. In the light of these considerations, it examines the 2017 health care reform, highlighting its problematic aspects and proposing an alternative interpretation consistent with the actual characteristics of care relationship in its current form.

Abstract

The paper aims to analyse the new features that characterize the concept of care relationship as a result of some recent changes in the ways of provision of health services. Especially, it intends to evaluate the possibility that care relationship could be established between patients and healthcare institutions instead of between patients and doctors working in these institutions. The paper leads therefore to some remarks concerning the attribution of liability to the different parties involved in the relationship. In the light of these considerations, it examines the 2017 health care reform, highlighting its problematic aspects and proposing an alternative interpretation consistent with the actual characteristics of care relationship in its current form.
