The essay aims to analyze the new phenomenon relevant in the EU common market: the “administrative creation” of new rights models (sometimes called givings, largess or new properties), as Airports slots, Milk quotas, Spectrum rights, Emission allowances, etc.. They represent a special kind of concessions or licences, that public authorities in any Member State usually assign under special allocation procedures to private people, firms or entities, in order to implement between them also a secondary trading. The aim of the research is to analyze, from the Italian legal system point of view, the possibility to qualify these “administrative rights” as special intangible assets, and identify the consequent regulation especially with reference to the rights holders position.
