After a short introduction on the most remarkable characteristics and the role of antitrust damages actions, we will analyze not only the state of the art with regard to the proof of harm and causal relationship in antitrust liability, especially according to the interpretation given by the Italian Supreme Court, but also the recent implementation of the Directive 2014/104/UE in Italy on January 19, 2017 (D.lgs. n. 3/2017). The file rouge is closely related to the simplifications of the rules on burden of proof: could the lastly mentioned “newness” improve private antitrust enforcement, even if the recent legislation doesn’t complain about collective redress mechanisms?
