Abstract This research examines the discipline of imputation of partial payment made for the compensation of a damage and perfomed before its liquidation. The first thing to consider is whether such payment should be attributed to the interest and costs or whether it should be taken from capital. Considering that the partial payment must be taken from capital, a second aspect to examine is whether such a sum of money should be subtracted from the value the damaged goods had when the damage occurred, at the moment of payment or when the judgment liquidated damage. This assessment is especially important for those goods which over time have variations cost significantly different from the average variation of the currency devaluation.
