Cette contribution vise à éclairer divers dysfonctionnements de la procédure législative de l’Union européenne: la baisse du nombre de décisions législatives, le haut niveau de consensus au Parlement européen, l’opacité du Conseil de l’UE, la généralisation des accords précoces de codécision et les droits gadgets accordés aux parlements nationaux. Ces différents phénomènes sont interprétés comme autant de symptômes d’une crise de confiance des différentes institutions européennes dans leur capacité à gouverner l’Union de façon efficace et légitime. Face à ce doute exis tentiel, nous suggérons différents mécanismes visant à garantir une meilleure publicité des conflits intra- et interinstitutionnels.

Abstract

This article attempts to explain several dysfunctions in the European Union's legislative process: the decline in the number of legislative decisions, the high degree of consensus in the European Parliament, the opacity of the Council of Ministers, the generalisation of premature agreements in the co-decision procedure and the granting of symbolic rights to national parliaments. These phenomena are interpreted as symptoms of a crisis of confidence in the ability of the various European institutions to govern effectively and legitimately. In order to address this existential doubt, we conclude by proposing several mechanisms aimed at improving public awareness of intra- and inter-institutional conflicts.
