L’applicazione del diritto dell’Unione da parte degli arbitri: riflessioni e prospettive in tema di rinvio pregiudiziale

The paper investigates the connection between arbitration and preliminary ruling of the European Court of Justice (and relative issues) resulting from the jurisprudence of the Court itself, with the view to identify the critical aspects connected to the current regime, the remedies already suggested as well a possible alternative solution in the light of the contractual theory of arbitration.
