La concessione portuale

The Italian port concession is governed by Article 18 of Law no. 84/94 on consolidation of legislation on port matters. The author focuses on the historical evolution of the port concession until the approval of the aforesaid Law. Then, he tries to define the juridical nature and scope of the port concession in the light of the Italian doctrine of concessions of public goods, reviewing the unclear aspects of the wording of Art. 18 of Law no. 84/94. Finally the author analyses the European Commission’s view on port concessions as well as the port concessions regimes in EU member states, deeply investigating the opinions of the international experts on this subject.
