The Globalization caused the crisis of the traditional concept of legal system and legal source production, and set at the same time the codes of conduct as a new rule–making instrument. This contribution will examine the self-regulation aspects of such conduct codes, in particular the most authoritative and well-established experiences expressed by self-regulation at a national and transnational level, taking into account both a comparative and a European perspective. Through this analysis, the author attempts to develop a grid of categories and concepts capable to explain the legal nature of these codes. This ensemble provides a perspective through which the contractual autonomy and market transformations can be monitored.
