Genitorialità: un fenomeno complesso

The essay traces the evolution of the parent-child relationship since the 1975 reform of Italian family law, focusing on the progressive affirmation of the best interests of the child and children’s evolving autonomy. The emergence of new forms of parenthood, not necessarily grounded in biological ties, raises the question of the relationship between legality and juridicity, as well as the limits within which the principles of personalism and solidarity may generate new legal norms. This calls for a redefinition of the legal framework governing parent-child relationships and of the boundary between legislative intervention and judicial interpretation.

Il contributo ricostruisce l’evoluzione del rapporto tra genitori e figli a partire dalla riforma del diritto di famiglia del 1975, soffermandosi sulla progressiva affermazione del best interest of the child e dell’autonomia del minore. L’emersione di nuove forme di genitorialità, non necessariamente fondate sul dato biologico, pone il problema del rapporto tra legalità e giuridicità e dei limiti entro i quali i principi personalistico e solidaristico possono produrre nuova normatività. Ne deriva l’esigenza di ridefinire lo statuto del rapporto genitoriale e il confine tra intervento legislativo e interpretazione giurisprudenziale.
