Technological innovation, vulnerability and ageing. The protection of the individual

In the multiplicity of challenges posed by technological innovation, the centrality of the concept of security emerges at the legal level and acquires new relevance through the declinations of the Cybersecurity. In this context, the language of law embraces different notions of vulnerability, which it applies differently to refer to both subjects and information systems. The elderly person, who is not inherently vulnerable, but may potentially be more so, finds specific consideration in the legal dimension of digital. In this sense can be understood the articulated normative response to the problem of algorithmic discrimination. The provisions of new technology law — public and private — thus work together to offer protection to the subject in his or her specific personal circumstances.

Nella molteplicità delle sfide poste dall’innovazione tecnologica, la centralità del concetto di sicurezza emerge sul piano giuridico e acquista nuova rilevanza attraverso le declinazioni della c.d. cibersicurezza. In questo ambito il linguaggio del diritto accoglie diverse nozioni di vulnerabilità, che applica differentemente per riferirsi tanto ai soggetti quanto ai sistemi informatici. La persona anziana, che non è per ciò solo vulnerabile, ma che potenzialmente può esserlo in misura maggiore, trova una specifica considerazione nella dimensione giuridica del digitale. In tal senso può intendersi l’articolata riposta normativa al problema della discriminazione algoritmica. Le disposizioni proprie del diritto delle nuove tecnologie – pubblico e privato – operano quindi congiuntamente per offrire tutela al soggetto, nelle sue specifiche condizioni personali.
