The research investigates the evolving contours of the European and Italian economic constitutions in light of the renewed prominence of public intervention following the pandemic crisis. The deployment of extraordinary financial instruments, the relaxation of State aid rules, and the suspension of fiscal constraints have reignited foundational debates on the relationship between market integration, democratic sovereignty, and collective needs. Within this reconfigured landscape, public services—and in particular, services of general economic interest—have regained centrality as instruments for safeguarding territorial cohesion and substantive equality. The research offers a detailed examination of the in-house providing model, tracing its normative and jurisprudential development and analysing its application in the field of local public transport. This analysis is enriched by empirical evidence and assessments from independent regulatory authorities. The thesis ultimately asks whether these developments signal a structural shift towards a renewed social constitution or merely constitute a contingent response to exceptional circumstances.
La tesi esamina l’evoluzione delle costituzioni economiche europea e italiana alla luce del rinnovato ruolo dell’intervento pubblico emerso in seguito alla crisi pandemica. L’introduzione di strumenti finanziari straordinari, l’allentamento del regime sugli aiuti di Stato e la sospensione temporanea delle regole fiscali hanno riaperto il dibattito sul rapporto tra integrazione economica, sovranità democratica ed esigenze collettive. In questo contesto, i servizi pubblici—e in particolare i servizi di interesse economico generale—riemergono come elementi centrali nella tutela della coesione territoriale e dell’eguaglianza sostanziale. La ricerca approfondisce il modello dell’in house providing, ricostruendone lo sviluppo normativo e giurisprudenziale e analizzandone l’applicazione nel settore del trasporto pubblico locale. L’analisi è arricchita da evidenze empiriche e dalle valutazioni formulate dalle autorità indipendenti. La tesi si interroga infine se tali dinamiche rappresentino l’inizio di una trasformazione strutturale verso una rinnovata costituzione sociale, oppure se debbano essere interpretate come risposte eccezionali e transitorie a una fase emergenziale.
