This special issue collects the papers and interventions from the conference presenting the results of the MIUR-PRIN 2022 project "Looking for Legislative Intent in Judicial Reasoning: An Empirical Account," which involved Bocconi University of Milan, the University of Brescia, the University of Milan "Statale," the University of Siena, and the University of Ca' Foscari of Venice. The conference took place in Venice on February 5 and 6, 2026. The issue is divided into two sections: the first includes a summary report of the empirical research findings, prepared by research fellows from the various units involved. The second section collects contributions from both scholars external to the project and from members of the individual units. Drawing on the research findings, they demonstrate their fruitfulness with regard to related theoretical and practical issues. Overall, this issue aims to highlight the importance of empirical research in the study of law, as well as the need for such research to be meaningful through appropriate theoretical tools, thus contributing to the development of legal science.
Questo fascicolo speciale raccoglie le relazioni e gli interventi del convegno nel quale sono stati presentati i risultati del progetto MIUR-PRIN 2022 “Looking for Legislative Intent in Judicial Reasoning: An Empirical Account”, che ha coinvolto l’Università Commerciale Bocconi di Milano, l’Università degli Studi di Brescia, l’Università degli Studi di Milano “Statale”, l’Università degli Studi di Siena e l’Università degli Studi “Ca’ Foscari” di Venezia, svoltosi a Venezia nei giorni 5 e 6 febbraio 2026. Il fascicolo si articola in due sezioni: la prima include il report sintetico dei risultati della ricerca empirica, redatto dagli assegnisti di ricerca delle diverse unità coinvolte. La seconda sezione raccoglie contributi formulati sia da alcuni studiosi sia esterni al progetto sia dai componenti delle singole unità che, muovendo dai risultati della ricerca, ne mostrano la fertilità con riguardo a questioni teoriche e pratiche attigue. Nel complesso, il fascicolo si propone di porre in luce l’importanza della ricerca empirica nello studio del diritto, come pure l’esigenza che tale ricerca si avvalga di strumenti teorici adeguati per risultare significativa, contribuendo così allo sviluppo delle scienze giuridiche.
