The contribution explores the phenomenon of gynecological and obstetric violence (GOV) in relation to the legal concept of vulnerability through an intersectional lens and how this has been approached by the jurisprudence of the European Court of Human Rights and of the InterAmerican Court of Human Rights. Ultimately, the contribution reflects on the different conceptualizations of the notion of vulnerability in the jurisprudence of human rights Courts by analyzing the cases of GOV which have made it to the Courts. What emerges is a fragmented scenario, with the InterAmerican Court using intersectionality as a tool for interpreting cases of GOV, whereas the same cannot be said for the ECtHR.

Abstract
The contribution explores the phenomenon of gynecological and obstetric violence (GOV) in relation to the legal concept of vulnerability through an intersectional lens and how this has been approached by the jurisprudence of the European Court of Human Rights and of the InterAmerican Court of Human Rights. Ultimately, the contribution reflects on the different conceptualizations of the notion of vulnerability in the jurisprudence of human rights Courts by analyzing the cases of GOV which have made it to the Courts. What emerges is a fragmented scenario, with the InterAmerican Court using intersectionality as a tool for interpreting cases of GOV, whereas the same cannot be said for the ECtHR.File | Dimensione | Formato | |
