This chapter critically looks at the legal notion of vulnerability to exploitation, examining relevant international instruments, as well as European and Italian legislation and case law of the European Court of Human Rights. We focus on the ‘situational’ dimension of vulnerability drawing from a gender and intersectional perspective. By questioning the use of vulnerability as a selective tool, we argue that vulnerability is potentially a powerful notion to address situations such as the exploitation of migrant workers. Such potential is correctly developed when the concept of vulnerability is used to grasp the intersections of personal and structural factors contributing to the making of migrants’ life experiences.
