In dubio pro futuris generationibus: una risposta giuridica eco-centrica alla slow violence

The purpose of this chapter is to reflect on on a possible articulation of the principle of intergenerational equity as a derivation not of the principle of sustainable development to which it is traditionally ascribed, but rather, questioning the anthropocentric approach of law, of the precautionary principle, read in the sense of environmental protection understood in a holistic sense as including the protection of future generations. In this regard, it will be argued, starting from the brocardo in dubio pro natura, in favour of a reading of the principle of intergenerational equity from an eco-centric perspective in dubio pro futuris generationibus. The phenomena to which the chapter refers fall under the definition of slow violence, which this chapter for the first time tries to "legalise".
