The aim of this book is to make a scientific contribution to the study of the current legal system of international trade in order to explain its operational applications and the regulatory coordination between rules under different legal systems. In light of the above, the focus will stay on the fundamental structure of exchanges with reference to B2B business operations: exports, imports, foreign direct investment and intellectual property. It becomes possible to isolate those acts, despite their lack of homogeneity, and studied their rules and understood because of their connection to several States or their role in international economic relations. The book is divided into 4 parts. The first part allows the reader to understand the scope of contemporary international trade law by reference to its actors in the regulatory system and the sources of the different standards. The sources of law have a different origin since they belong to National legal systems, the International legal system and the a-national realm. Then, in the second part of the book, the main contracts for international trade (from sale, international transport, freight insurance and payment systems) will be examined together with foreign direct investment operations. In the third and final part of the book, the focus will be on mechanisms for the settlement of international trade disputes, starting with international arbitration and concluding with some final considerations about international civil procedure law.

Questo libro si propone di offrire un contributo scientifico allo studio del sistema del Diritto del commercio internazionale contemporaneo vigente per spiegare le sue applicazioni operative ed il coordinamento normativo tra regole appartenenti a diversi ordinamenti. Alla luce di quanto premesso, ci proponiamo di studiare al struttura e la funzione delle norme regolatrici le principali operazioni di commercio internazionale business to business ed off line: esportazioni, importazioni, investimenti diretti esteri e proprietà intellettuale. Questi atti, nonostante la diversa omogeneità delle norme che aspirano a regolarli, possono essere studiati e compresi in ragione del loro collegamento a più Stati o del loro ruolo nelle relazioni economiche internazionali, ossia attraverso il loro comune carattere internazionale. Per comprendere la vitalità (e la vastità) del diritto del commercio internazionale contemporaneo occorre studiare dapprima gli attori del sistema normativo e le fonti delle singole norme: fonti appartenenti ad ordinamenti giuridici di diversa natura formale ed estensione entro i quali formano delle unità organiche. Successivamente si studieranno i principali contratti del commercio internazionale (muovendo da vendita, trasporti internazionalei, assicurazione merci e sistemi di pagamento) (II); gli investimenti diretti esteri e i meccanismi di risoluzione delle controversie del commercio internazionale (III) iniziando dall'arbitrato internazionale e concludendo con alcuni profili istituzionali di diritto processuale civile internazionale.
