The accentuation of '' regulatory '' decentralization which then resulted in what has been called '' corporatization '', or with the tendency of corporate interest to adapt the labor discipline to technical-productive needs, seems to become the new fulcrum of legal regulation of working conditions: if on the one hand this seems to achieve a overturning in the hierarchy of interests, placing the employer's interest and the technical-productive reason at the center of the system of trade union relations company with respect to the interests of the workers, on the other hand it cannot be considered that, in the face of one different economic organization of the country and a different company organizational model, this new possibility could give new life to the original trade union freedom, expression of an effective solidarity between workers of the same company, representing the tool through which to revisit the rules of work adapting them to the productive reality to which they infer. The current approaches to second-hand bargaining level are therefore the result of modifications of economic, political and social elements that have always made the pendulum swing now towards national bargaining now towards other levels, so much so that, as well explained by Giugni, the variables that most influence the structure of collective bargaining are on the one hand the configuration of the production system e organizations representing companies, on the other hand, the situation of the labor market and the trend of the economic cycle
L’accentuazione del decentramento ‘‘normativo’’ sfociato poi in quella che e` stata chiamata ‘‘aziendalizzazione’’ (12), ovvero con la tendenza dell’interesse aziendale ad adattare la disciplina del lavoro alle esigenze tecnico-produttive, sembra diventare il nuovo fulcro di regolamentazione giuridica delle condizioni di lavoro: se da un lato cio` sembra realizzare un capovolgimento nella gerarchia degli interessi, ponendo al centro del sistema di relazioni sindacali l’interesse datoriale e la ragione tecnico-produttiva aziendale rispetto all’interesse dei lavoratori, dall’altro non puo` non considerarsi che, a fronte di una diversa organizzazione economica del Paese e di un diverso modello organizzativo aziendale, questa nuova possibilita` potrebbe ridare linfa alla originaria liberta` sindacale, espressione di una effettiva solidarieta` tra lavoratori di una stessa impresa, rappresentando lo strumento attraverso cui rivisitare le regole del lavoro adattandole alla realta` produttiva alla quale inferiscono. Gli attuali approdi della contrattazione di secondo livello sono dunque il frutto di modificazioni di elementi economici, politici e sociali che da sempre hanno fatto oscillare il pendolo ora verso la contrattazione nazionale ora verso altri livelli, tanto che, come ben spiegato da Giugni, le variabili che piu` influenzano la struttura della contrattazione collettiva sono da un lato la configurazione del sistema produttivo e delle organizzazioni di rappresentanza delle imprese, dall’altro la situazione del mercato del lavoro e l’andamento del ciclo economico
